What Are Our Terms and Conditions?

A Straightforward Guide To Our Terms

None of us enjoy the small print, so everything you need is set out clearly on this one page.

Terms used throughout:

Business: Leon Britton Photography.
Client(s): the parties to the contract.
Event: the event named in the contract.
Photographer(s): Leon Britton Photography.
Products: any USBs, albums, or other items listed in the contract.
Services: the photography services carried out at the event, plus any other services agreed between the client(s) and the photographer and set out in the contract.

Website, Copyright & Trademarks

All website design, text, graphics, and their selection and arrangement, along with all software, source code, and other material on this website, are the copyright of Leon Britton Photography or its content and technology providers. All rights reserved.

You’re welcome to copy and print portions of this website for the sole purpose of placing an order with us. Any other use — including reproduction, modification, distribution, or republication — requires our prior written permission.

Leon Britton Photography’s services referenced on this website are trademarks or registered trademarks of Leon Britton Photography in the UK and/or other countries. Other product and company names mentioned may be the trademarks of their respective owners.

To the fullest extent permitted by law, this website and its contents are provided on an “as is” basis, with no warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose. We do not warrant that information on this site is accurate, complete, or current, and pricing and availability are subject to change without notice.

Except as specifically stated on this website, and to the fullest extent permitted by law, neither Leon Britton Photography nor its affiliates, directors, employees, or other representatives will be liable for damages arising from use of this website or its content. This is a comprehensive limitation applying to all damages of any kind — compensatory, direct, indirect, or consequential — including loss of data, income, profit, property, or third-party claims. For the avoidance of doubt, we do not limit liability for death or personal injury arising from our own negligence.

These terms, together with the contract, form the entire agreement between the parties. No variation is effective unless agreed by both parties in writing, and each party confirms it has not relied on any statement outside those expressly set out in the contract and these terms.

Booking Fee & Payments

Booking fee: once cleared funds for the booking fee are received, we’ll confirm the event, date, time, and services. The booking fee is non-refundable and non-transferable if the client cancels.

Payments: around 2–3 weeks before the event, we’ll be in touch to arrange a pre-event appointment if needed. Any remaining balance is due by the pre-event meeting date, and all payments must be cleared before the event.

Following the booking fee, the balance is due as follows:

  • An amount equal to the booking fee is due 12 months before the event date.
  • The remaining balance is due at the pre-event meeting, or 14 days before the event if no meeting is held.
  • Payment for additional images or products is due at the time of order.

Missed payment deadlines may result in cancellation. Cheques should be made payable to Leon Britton; bank transfer (BACS) is also accepted. Late payments or returned cheques attract a £25 administration charge, and no photographs or albums are delivered until all payments have cleared in full. Where a third party is paying on the client’s behalf, the client remains responsible for any outstanding balance.

Licence, Coverage & Artistic Judgement

We’re granted artistic licence over poses and locations photographed. While we’ll always aim to meet the client’s brief, final judgement on location, poses, and number of photographs rests with the photographer, and these decisions aren’t subject to dispute.

For events at churches or certain venues, our movement, use of artificial lighting, and ability to photograph parts of the ceremony may be restricted by the venue or officiant — we can’t accept responsibility for coverage limited in this way. Similarly, we can’t be held responsible for delays or missed shots caused by non-availability of subjects or conditions beyond our control.

Any changes to a confirmed contract are at the photographer’s discretion and should be agreed in writing. If we’re unable to accommodate a change (such as a new ceremony date or venue), we won’t be liable to compensate the client for this.

Image Use, Reproduction & Retouching

Quoted print and presentation sizes are approximate and may vary slightly. While we always aim for accuracy, we can’t guarantee exact colour matching across all conditions, and images may appear differently depending on the monitor or device used to view them.

Where images are supplied on a USB device, we take reasonable steps to ensure compatibility using quality branded media, each checked before delivery — though it remains the client’s responsibility to check for damage in transit. Retouching, digital manipulation, and artistic finishing are available as an optional extra. Reorders are treated as an extension of the contract, and we can’t accept responsibility for errors unless orders are confirmed in writing.

If a specific product (such as an album) becomes unavailable, we’ll offer a suitable alternative of similar quality; any surcharge for ordering a different replacement is the client’s responsibility.

Ownership & Copyright

All images remain the sole property of the photographer at all times, as do any completed albums or products until payment is received in full.

Images, whether stored digitally or otherwise, are protected under the Copyright, Designs and Patents Act 1988 and remain the photographer’s copyright unless otherwise agreed in writing. Copying or reproducing an image created under this contract without written permission is contrary to the Act.

For headshot or portrait sessions, clients are granted usage rights to use their images online for personal or business promotion. Unless requested otherwise, images may also appear in our portfolio to showcase our work. Selection happens via an online gallery whose cover image may be searchable, though gallery contents are not. Where images appear in print media, books, or via third parties (such as agency websites or magazines), photographer credit must be given.

Substitution & Insurance

In the unlikely event the assigned photographer can’t attend due to unforeseen circumstances, Leon Britton Photography reserves the right to appoint another suitable photographer to cover the event on our behalf.

We maintain Public Liability and Professional Indemnity insurance at all times. In the unlikely event of total photographic failure or contract cancellation by either party, liability is limited to the total value of the contract, and neither party is liable for indirect or consequential loss.

Force Majeure & Conduct

Performance of this contract may be altered or cancelled due to a Force Majeure Event — one beyond a party’s control that could not reasonably have been foreseen or avoided, including acts of God, storms, floods, riots, fires, civil unrest, war, terrorism, or failure of energy sources. This does not cover situations where we attend to perform the services and a party simply fails to attend.

Clients are responsible for the co-operative behaviour of guests and subjects at a shoot. If the photographer feels unsafe or is subject to abuse and the client cannot control the situation, the photographer may leave without forfeiting the contract (for example, drunk or abusive guests at a wedding).

Makeup & Attire

We understand how much appearance matters in photographs, and we’re always happy to offer guidance on makeup, attire, and formal wear. Clients can review their appearance before, during, and after the session to confirm they’re happy with it.

While we offer suggestions, the final decision on makeup and attire — and how it’s worn — rests with the client or their representatives. We’d encourage sharing preferences in advance so we can help you achieve the look you want.

Cancellation Policy

If we need to cancel due to circumstances beyond our control, the full booking fee and any further payments will be refunded, and we’ll arrange a re-shoot where practicable — though we won’t be responsible for any additional costs this causes the client.

If the client wishes to cancel, written notice must be given. For weddings:

  • 365 days or more before the date: booking fee only.
  • Between 182 and 365 days before: 50% of the agreed balance is payable.
  • 182 days or less before: 100% of the agreed balance is payable.

Where no package has been selected, the agreed balance is treated as £1,000, and the cancellation date is the date we receive written notice. A postponement is treated as a cancellation under the above structure, though if we can accommodate the new date, 50% of the amount due can be transferred to it under a new contract.

Studio and outdoor location sessions: dates are secured with a non-refundable, non-transferable booking fee (deductible from the session total). Rescheduling more than two working days before your session keeps your deposit; less than 48 hours’ notice forfeits it. For outdoor sessions affected by weather, we’ll contact you on the morning to discuss options, and can usually reschedule without loss of deposit provided travel costs haven’t already been committed. If we need to cancel within 24 hours of your session, we’ll offer an extra retouched image on rescheduling as a thank you for your patience.

Commercial and B2B clients receive a copy of the relevant terms alongside their quotation and on request.

Studio Session Terms and Conditions

The following terms apply specifically to studio sessions — headshots, portraits, personal branding, and dating-profile photography — booked at our studio, in addition to the general terms above.

Punctuality: sessions begin at the scheduled time. If a client arrives late, the session still ends at the originally scheduled finish time — we’re not able to extend a session to make up for lost time, as this may affect other bookings that day.

Image licence: clients are granted a non-exclusive licence to use their images for personal or business promotional use (e.g. your website, social media, LinkedIn, printed materials for your own business). This licence does not permit reselling the images, submitting them to a stock photo library, using them in paid advertising beyond your original brief, printing them on merchandise or packaging for sale, or passing them to another business or individual for their own use. Any use beyond what’s described here needs our written permission first.

Retouching: where retouching or digital manipulation is requested, one round of reasonable amendments is included. Further rounds of changes beyond this may incur an additional charge, agreed with the client in advance.

Payment: your booking fee is non-refundable and secures your session date. Once you’ve confirmed your final image selections, the remaining balance becomes due, payable within 7 days. Editing begins as soon as your invoice has cleared.

Delivery timeframe: final images are typically delivered within 7–10 days of your invoice clearing. This is an estimate rather than a guarantee — busier periods may take a little longer, and we’ll let you know if that’s the case for your booking.

Your gallery: once delivered, your online gallery stays live and downloadable for up to 12 months. We’d love you to get everything saved well before then — after 12 months the gallery may be archived and taken offline, so it’s worth setting yourself a reminder.

Age requirement: dating-profile sessions are only available to clients aged 18 and over. Booking this type of session confirms you meet that requirement.

A good studio experience, for everyone: we want every session to feel relaxed and positive. If a client’s behaviour becomes abusive, threatening, or otherwise makes it unsafe or impractical to continue, we reserve the right to end the session early. We’ll always try to talk things through calmly first, but in this situation the booking fee remains non-refundable.

Complaints & Governing Law

Complaints should be raised in writing within 14 days of the issue arising, and we’ll respond within 14 days of receiving it. Formal notices relating to the contract should be sent in writing by recorded delivery to the address stated in the contract.

These terms are governed by English law, and the courts of England and Wales have exclusive jurisdiction over any dispute.
